Defects in certain vehicles - sometimes causing them to accelerate out of control or fail to decelerate upon command- fall within an area of law called product liability law. Those who design, produce, and market products must offer products that are reasonably safe. Sadly, some manufacturers put profit ahead of people and release vehicles before all the kinks have been worked out. The results can be dangerous and even deadly.
The Cause
The National Highway Traffic Safety Administration (NHTSA) is investigating the cause of hundreds of incidents of vehicles uncontrollably accelerating and causing crashes.
Some manufacturers at first blamed floor mats or carpeting for interfering with the accelerator, and causing the car or pickup to take off. They have recalled millions of suspect vehicles.
Other experts have think there may be a problem with the electronic throttle systems in certain vehicles. The ETC is designed to detect the pedal position, and may in some cases, be faulty in some respects. The device may "think" the pedal is depressed further than the driver has actually pushed it. "Thinking" the driver wants to accelerate, he device revs the engine, and disaster results.
In other incidents, a driver surprised by a sudden lurch or surge of the vehicle may depress the brake once. In a situation of wide-open throttle, even a minor pump of the brake can deplete the power-assist braking and leave the brakes insufficient to overcome the power of the acceleration.
